These Terms of Service ("Terms") are a legally binding contract between you and SoulVia LLC ("SoulVia," "we," "us," or "our"). By accessing or using SoulVia in any way, you agree to be bound by these Terms. If you do not agree, do not use SoulVia.
These Terms incorporate our Privacy Policy by reference. Both documents together constitute the full agreement between you and SoulVia.
SoulVia is an AI-powered spiritual guidance application that draws from the world's major holy texts to offer reflection and perspective. It is a spiritual companion, not a licensed professional service of any kind.
SoulVia is not:
AI disclosure: SoulVia's responses are generated by artificial intelligence (Anthropic's Claude API). Responses are not written by human experts, are not reviewed by theologians or clergy before delivery, and do not represent the official position of any religious tradition or institution. AI-generated content may contain errors, misattributions, or theological inaccuracies. You are solely responsible for how you interpret and act on any content SoulVia provides.
Nothing in SoulVia constitutes professional advice of any kind. Do not make significant life, medical, legal, financial, or religious decisions based solely on SoulVia's responses.
SoulVia is not a substitute for professional mental health care. If you are experiencing a mental health crisis, thoughts of suicide or self-harm, or any psychiatric emergency, stop using SoulVia immediately and contact:

SoulVia is designed to redirect users experiencing crisis to professional resources. However, we cannot guarantee that AI-generated responses will always recognize or appropriately respond to every crisis situation. You assume all risk associated with using SoulVia during periods of emotional vulnerability. SoulVia shall not be liable for any harm arising from reliance on AI-generated responses in a crisis situation.
You must be at least 13 years old to use SoulVia. If you are between 13 and 18, you may only use SoulVia with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
If you are located in the European Union, you must be at least 16 years old, or have verifiable parental consent in accordance with the EU General Data Protection Regulation (GDPR).
By using SoulVia, you represent that you meet these age requirements. We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will terminate that user's access and delete any associated data.
California residents: If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal data we collect, the right to delete it, and the right to opt out of its sale. Query top-ups: $1.99 for 30 additional queries, available once the monthly allocation is exhausted.
Auto-renewal: Subscriptions renew automatically. You will be charged at the start of each new billing cycle unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis. You will receive a reminder before each annual renewal.
Sales tax: SoulVia is a SaaS product subject to Indiana's 7% sales tax. Applicable taxes will be calculated and added at checkout based on your billing address. Users outside Indiana may be subject to their own jurisdiction's applicable taxes, which will be calculated at checkout.
Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing cycle. You will retain access to your subscription until that date. We do not provide partial refunds for unused time within a billing cycle.
Refunds: All purchases are final except where required by applicable law. If you believe you were charged in error, contact us at legal@soulvia.app within 30 days of the charge.
Price changes: We will notify you at least 30 days before any price increase. Continued use after that date constitutes acceptance of the new price.

All content, design, code, personas, names, branding, and system architecture of SoulVia are the intellectual property of SoulVia LLC and are protected by applicable copyright, trademark, and intellectual property laws.
"SoulVia" and "The Eleven" are trademarks (pending registration) of SoulVia LLC. You may not use these marks without written permission.
Scripture passages referenced or paraphrased by SoulVia are drawn from public domain translations and are not claimed as SoulVia's intellectual property.
You retain ownership of any content you submit to SoulVia. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of delivering the service. We do not store, sell, or use your conversation content for any other purpose.
SoulVia relies on third-party services to operate, including Anthropic (AI), Vercel (hosting), Supabase (database), and Stripe or equivalent (payments). Your use of SoulVia is also subject to their respective terms of service and privacy policies. We are not responsible for the acts or omissions of these third parties.
SoulVia is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that SoulVia will be available at all times or free from errors, that AI-generated responses will be theologically accurate or appropriate for your situation, or that scripture citations will be error-free or contextually accurate.
To the fullest extent permitted by applicable law, SoulVia's total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, consequential, punitive, or special damages, including loss of data, loss of revenue, emotional distress, or harm arising from reliance on AI-generated content, regardless of whether we were advised of the possibility of such damages.
Some jurisdictions do not allow certain liability exclusions or limitations. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless SoulVia LLC, its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of SoulVia, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Indiana.
Informal resolution: Before initiating any formal dispute, you agree to contact us at legal@soulvia.app and attempt to resolve the dispute informally for at least 30 days.
Arbitration: If informal resolution fails, any dispute shall be resolved by binding individual arbitration under the rules of the American Arbitration Association. You waive the right to participate in a class action lawsuit or class-wide arbitration. This arbitration clause does not apply to claims that qualify for small claims court.
Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
We may update these Terms at any time. When we make material changes, we will notify users via in-app notice or email at least 14 days before the change takes effect. Continued use of SoulVia after that date constitutes acceptance of the updated Terms. The version of the Terms in effect at the time a dispute arises governs that dispute.
We reserve the right to suspend or terminate your access to SoulVia at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us at legal@soulvia.app. Upon termination, your right to use SoulVia ceases immediately.
SoulVia is built on the belief that spiritual guidance should create good in the world beyond the individual. SoulVia intends to dedicate a portion of revenue to charitable causes aligned with its mission of spiritual wellbeing, human dignity, and compassionate service. Details of this program, including recipient organizations and giving percentages, will be published at soulvia.app as the program develops.
This section does not create a binding legal obligation to any specific charitable commitment until formally published as a separate giving policy. It is a statement of intent and organizational values.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and SoulVia regarding your use of the service and supersede all prior agreements.
